Privacy Policy

1. General information

This document sets out the rules for the processing of personal data within the online shop operated at https://elperro.com.pl by EL PERRO JUSTYNA NOWIK JACEK NOWIK SPÓŁKA JAWNA, with its registered office at ul. Dębowa 1, 18-106 Niewodnica Korycka, NIP (tax identification number): 9662042798, e-mail: sklep@elperro.com.pl, hereinafter referred to as the “Controller”.

2. Purposes and legal bases of data processing

Personal data are processed:

- in order to fulfil orders (Article 6(1)(b) of the GDPR, i.e. Regulation (EU) 2016/679),

- to maintain the customer account (Article 6(1)(b) GDPR),

- for marketing communications – newsletter, SMS, e-mail (Article 6(1)(a) GDPR),

- to handle complaints and returns (Article 6(1)(b) GDPR),

- to issue invoices and keep accounting records (Article 6(1)(c) GDPR),

- for statistical, analytical and marketing purposes on the basis of the Controller’s legitimate interest (Article 6(1)(f) GDPR).

3. Scope of the data processed

The Controller may process the following data:

- first name and surname,

- residential / delivery address,

- e-mail address,

- telephone number,

- invoicing data (tax identification number (NIP), company name),

- payment data (indirectly via the payment operators Tpay and Revolut),

- technical data (IP address, device type, browser, cookies).

4. Cookies and tracking technologies

The website uses cookies and tracking technologies for statistical and marketing purposes, including:

- Google Analytics – analysis of statistics and user behaviour,

- Facebook Pixel – personalisation and measurement of the effectiveness of advertising campaigns,

- Hotjar – analysis of user experience (UX).

Cookies may be stored on the user’s terminal equipment with the user’s consent (Article 6(1)(a) GDPR). The user can manage cookies in their browser settings.

5. Recipients of data

Personal data may be transferred to the following categories of recipients:

- payment operators: Tpay (Krajowy Integrator Płatności S.A.) and Revolut,

- courier companies and a shipping broker: InPost, UPS, Apaczka.pl,

- the accounting office that keeps the books,

- IT and hosting service providers,

- mailing platforms (e.g. MailerLite).

Data may be transferred outside the European Economic Area (e.g. in connection with the use of Google or Facebook), in which case the Controller ensures that appropriate protection mechanisms, such as standard contractual clauses, are applied.

6. Customer account

Creating an account makes it possible, among other things, to track orders and access the purchase history. The data are stored until the account is deleted or for the limitation period for claims.

7. Newsletter and marketing communications

Subscribing to the newsletter is voluntary and requires consent. Every message contains an unsubscribe link. The user may withdraw consent to receiving marketing content at any time.

8. Reviews and comments

Users may publish product reviews, which may contain their first name, the content of the comment and a rating. Reviews are publicly visible.

9. Data retention period

- Order fulfilment data – 6 years (in accordance with tax regulations),

- Marketing data – until consent is withdrawn,

- Account data – until the account is deleted or deactivated,

- Cookie data – up to 24 months or until they are deleted by the user.

10. Users’ rights

Every data subject has the right to:

- access the data,

- rectification of the data,

- erasure (the right to be forgotten),

- restriction of processing,

- data portability,

- object,

- withdraw consent at any time (without affecting the lawfulness of processing carried out before its withdrawal),

- lodge a complaint with the President of the Personal Data Protection Office (UODO).

11. Automated decision-making and profiling

Profiling may take place in connection with the use of analytical and marketing tools. However, no decisions producing legal effects concerning the user are taken by automated means.
